O R D E R

This Writ Petition is filed challenging the appointment of the fifth respondent as a handball coach by the first respondent. The fifth respondent was appointed as a handball coach by the first respondent pursuant to the impugned proceedings of the first respondent dated 03.03.2023.

2.The petitioner claims that the fifth respondent had submitted bogus certificates issued by the third and fourth respondents for the purpose of getting appointed as a handball coach.

3.A counter affidavit has been filed by the fourth respondent before this Court, where they have stated that the certificates issued by them to the fifth respondent are genuine ones. Only by submitting the certificates issued by the fourth respondent, the fifth respondent got himself appointed to the post of handball coach.

4.It is also contended by the fifth respondent that the player registration form filed by the petitioner along with this Writ Petition is a bogus one.

5.Before this Court, the petitioner has not produced any clinching / conclusive evidence to prove that the fifth respondent had submitted bogus certificates for the purpose of getting appointed as a handball coach. The official respondents have also stated through their respective counters that the fifth respondent had submitted only genuine certificates to enable the fifth respondent to get appointed as a handball coach. When there is no clinching / conclusive evidence placed on record by the petitioner to prove that the fifth respondent had secured employment as a handball coach by furnishing bogus documents and that too, when the official respondents have themselves not admitted the contention of the petitioner, the question of entertaining this Writ Petition does not arise, since there are disputed questions of facts and law involved and that too, when there is no clinching / conclusive to prove that the fifth respondent has submitted bogus certificates, this Court does not find any merit in this Writ Petition.

6.Accordingly, this Writ Petition stands dismissed. There shall be no order as to costs. Consequently, connected miscellaneous petitions are closed.
