PRAYER :- For Bail in Crime No.196 of 2021 on the file of the respondent police.

ORDER : The Court made the following order :- The petitioner/A3, who was arrested and remanded to judicial custody on 18.04.2021 for the offences punishable under Sections @ 302, 201 of IPC on the file of the respondent police seeks bail. 2.The case of the prosecution is that the defacto complainant is the mother of the deceased and the deceased is the husband of A1. The petitioner herein is the paramour of A1. On 01.09.2018 the accused persons gave poison to the deceased and thereafter they buried the dead body inside the house of A1. Thereafter the Tahsildhar found the dead body and the case has been altered to Sections 302 and 201 of IPC. Hence the complaint.

3. The learned counsel for the petitioner would submit that the name of the petitioner does not found place in the First Information Report and no specific overt act has been attributed against the petitioner. He would further submit that the petitioner is in jail from 18.04.2021, hence he seeks bail.

4. The learned Government Advocate(Crl.Side) would submit that the investigation is at the nascent stage.

5. Taking into consideration the grave nature of offence committed by the petitioner and the investigation is at the nascent stage and also the fact that the petitioner was arrested only on 18.04.2021, this Court is not inclined to grant bail to the petitioner.
