ORDER

The present Writ Petition has been filed for the issuance of a Writ of Certiorarified Mandamus, to quash the impugned order dated 03.02.2026 passed by the first and consequently direct the third respondent herein to change the patta in favour of the petitioner and his daughter with regard to property in Survey No.179/1A an to extent of 33 cents situated at Nagamugunthankudi group, Ilayankudi Taluk, Sivagangai District.

2. According to the petitioner, one Ponnalagu Konar was the owner of the subject property and had two sons, namely, Sanga Konar and Ponnalagu. However, the said genealogy is disputed by the fourth respondent.

3. This Court finds that the impugned order has been passed without issuing notice to the petitioner. Based on the fourth respondent's claim, the impugned 2/4

order has been passed. Even in the reference column, it has not been stated whether a copy of the proceedings has been served to the petitioner. Therefore, it is evident that no notice was issued to the petitioner. Even as on date, a copy of the impugned order has not been served on the petitioner. Hence, there is a clear violation of the principles of natural justice. Accordingly, the impugned order is hereby quashed and the matter is remitted back to the concerned authorities. The official respondents shall consider the claims of the petitioner as well as the fourth respondent, after issuing notice to both parties and affording them an opportunity of personal hearing, and pass appropriate orders on merits in accordance with law, within a period of four months from the date of receipt of a copy of this order.

4. With the above directions, this Writ Petition is disposed of. There shall be no order as to costs. Consequently, connected miscellaneous petitions are closed.
