O R D E R

This petition has been filed seeking to call for records pertaining to the impugned order passed by the 1st respondent by his proceedings in Na.Ka. No.4253/25/E4 dated 15.12.2025, quash the same and consequently direct the respondents to carry out survey and demarcate by fixing the four boundaries of petitioner's land in Survey No.43/46, 43/47 admeasuring of 0.2.11 Ares, situated in Melakkottai Village, Thirumangalam Taluk, Madurai District on the basis of prescribed fees being made vide challans dated 28.04.2025 and within stipulated time.

2. The learned counsel for the petitioner submitted that the petitioner had purchased two plots of land in plot No.8A and 21A, which are part of Survey Nos. 43/46 and 43/47, situated at Melakkottai Village, Thirumangalam 2/6

Taluk, Madurai District. This purchase was made from one Krishnan through a registered sale deed (Doc.No.7522/2010) dated 06.08.2010. After the purchase, the revenue records were updated, and the patta was issued in the petitioner's name. The petitioner is now seeking to have the property surveyed. However, the first respondent has declined the request, citing a lack of clarity regarding the property's boundaries.

The learned Additional Government Pleader appearing for the respondents submitted that the respondents' specific objection lies in the fact that the petitioner is requesting a survey of the property located in Survey Nos. 43/46 and 43/47. However, there are no survey stones available in those areas, and the survey stones are only located in Survey Nos. 43/8 and 43/9. The petitioner was directed to circulate a sketch indicating the location of the property. The petitioner has produced a sketch indicating the properties in Survey Nos. 43/8 and 43/9, which encompass a larger area, with a smaller portion marked as Survey Nos. 43/46 and 43/47. The petitioner seeks to survey this smaller portion of land. 3/6

Considering the facts and circumstances of the case, this Court directs the respondents to conduct a survey of the property based on the sketch, with the petitioner having purchased the property in two plots, No. 8A and 21A, after issuing notice to the petitioner and any rival . If necessary, seek police protection, the Jurisdictional police shall provide police protection to survey the land. The Court is also directing the Official respondents to adhere to the following Standard Operating Procedures:

a. The Official respondents shall issue notice to the petitioner immediately reaching the spot where survey is to be conducted. The petitioner shall affix the signature by receiving the notice of survey.

b. After survey again the petitioner shall affix signature indicating that the survey was conducted to their satisfaction.

c. If the petitioner is not satisfied, then also the petitioner shall affix signature indicating their dissatisfaction or with protest. The petitioner shall indicate that reason of their dissatisfaction or protest. 4/6

The aforesaid procedure shall be strictly followed by the parties The said exercise shall be completed within a period of 12 weeks from the date of receipt of a copy of this order.
