Respondent / Complainant Criminal Revision Case filed praying that in the circumstances stated therein and in the petition filed therewith the High Court may be pleased to call for the records of the learned Additional District Judge / Principal Sessions Court / Special Court for E.C. and NDPS Act Cases, Madurai in CR.M.P.No.137 of 2019 dated 22.01.2019 and to set aside the same and further direct the learned Additional District Judge / Principal Sessions Court / Special Court for E.C.

and NDPS Act Cases, Madurai to grant interim custody of vehicle, a Jeep viz., MAHINDRA - THAR bearing Registration No.KL 31 E-9699 to the petitioner. Order : This criminal revision case coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S. RAMESH.M, Advocate for the petitioner and of Mr.T.

When the matter is taken up for hearing, the learned Additional Public Prosecutor appearing for the State submitted the details regarding the vehicles involved in the NDPS Act Cases.

2. According to the learned Additional Public Prosecutor, as on date, 3688 vehicles were involved in the NDPS Act cases. Among the 3688 vehicles, unclaimed vehicles are 2787. The Investigating Agency filed petitions before the concerned Court relating to 1467 vehicles to proceed further in accordance with law. Insofar as 1230 vehicles are concerned, petitions are yet to be filed.

3. Recording the said submission, this Court adjourned the case to 29.11.2023 to comply with the order of this Court passed earlier.

4. It is made clear that no further time is granted for any reason. The concerned Officer is strictly directed to take necessary steps to file applications before the Court as per the direction issued by this Court earlier. If there is any deviation in the compliance of the order, the concerned Superior Officer shall appear before this Court and file explanation with affidavit.

5. The learned Additional Public Prosecutor further submitted that a Nodal Officer in the rank of Deputy Superintendent of Police was appointed to monitor the procedure for the NDPS Act Cases.

6. The above step taken by the Department is appreciated by this Court. This 2/5

Court expected that the Nodal Officer, who appeared before this Court shall periodically monitor the entire NDPS cases from the stage of registration till the disposal of the case. The Nodal Officer also has to ensure the filing of the final report within a prescribed period.

7. The learned Additional Public Prosecutor appearing for the State further submitted that after appointment of Nodal Officer, strict compliance of 52(A) of the NDPS Act has been commenced. This is a further welcome step taken by the Department.

8. Hence, this Court directed the learned Additional Public Prosecutor to produce the report regarding the compliance of Section 52(A) of the NDPS Act.

9. Post this matter on 29.11.2023.
