O R D E R

[Order of the Court was made by N.ANAND VENKATESH, J.] This writ petition has been filed challenging the proceedings of the second respondent made in impugned order No.218/Otha.2/2026 dated 02.03.2026, wherein the second respondent while granting ordinary leave for 28 days imposed a condition that the detenu will be accompanied by an escort. Aggrieved by this condition, the present writ petition has been filed before this Court.

2. Heard the learned counsel on either side.

3. The petitioner is the wife of the detenu. The detenu is a life convict. The petitioner underwent a surgical procedure and was advised

total bed rest. The petitioner was not able to arrange for the necessary finance. Hence, the petitioner submitted a representation before the respondents seeking for ordinary leave for her husband.

4. The second respondent through the impugned proceedings dated 02.03.2026 granted 28 days ordinary leave with escort.

5. The learned Additional Public Prosecutor on instructions brought to the notice of this Court that even on an earlier occasion, the detenu was granted ordinary leave without escort.

6. Taking into consideration the facts and circumstances of the case and the reasons for which the ordinary leave has been sought for, we are inclined to modify the condition. The detenu shall report before the third respondent Police every day at 06.00 p.m., during the entire period of ordinary leave. Apart from that condition, the detenu is permitted to execute the sureties before the Superintendent of Prison, Central Prison, Palayamkottai, instead of executing the sureties before the Tahsildar and two sureties shall be the family members of the detenu. The other conditions imposed by the second respondent shall stand as it is.
