ORDER : The Court made the following order :- The petitioner, who was arrested on 11.01.2024 for the alleged offence under Section 5(l) (j)(ii) and 6 of Protection of Children from Secual offences Act, 2012 in Crime No.2 of 2024 on the file of the respondent police, seeks bail. 2.The case of the prosecution is that on 11.10.2023 at 01.00 noon, when the 1/3

victim girl came to the petitioner's house, the petitioner had committed sexual assault upon the victim girl. As a consequence, she became pregnant. 3.The learned counsel for the petitioner submits that the petitioner is languishing in jail for more than three months. He has already moved a bail application before the Sessions Judge, Special Court for POCSO Act Cases, Tirunelvei (F.A.C) in Crl.M.P.No.806 of 2024 and the same was dismissed on 19.03.2024. Hence, he prays for grant of bail.

4.The learned Additional Public Prosecutor strongly opposed to grant bail on the ground that the petitioner has been involved in a similar offence, for which, he was already arrested and released on bail and again, he has committed the same offence.

5.Considering the conduct of the petitioner in committing the offence repeatedly, this Court is not inclined to grant bail to the petitioner. 6.Accordingly, this petition is dismissed.
