Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents to consider the petitioner's representation dated 09.04.2022 seeking correction in the Village FMB sketch of Ponnusangampatti Village pursuant to the S.No.859/1A of Ponnusangampatti Village, Thuraiyur Taluk, Trichy District based on the joint patta No.617 issued to the petitioner and his brother and pass appropriate orders in accordance with law within a time stipulated by this Court.

ORDER

This Writ Petition has been filed for a Mandamus seeking for a direction to the respondents to consider the petitioner's representation dated 09.04.2022 seeking for correction of the Village FMB sketch in accordance with the joint patta standing in the name of the petitioner and his brother for the property comprised in Survey No.859/1A of Ponnusangampatti Village, Thuraiyur Taluk, Trichy District bearing Joint Patta No.617.

2. Heard Mr.N.Anandkumar, learned counsel for the petitioner and Mr.D.Sasikumar, learned Additional Government Pleader, who accepts notice on behalf of the respondents.

3. The petitioner has filed documents along with the Writ Petition including the Joint Patta No.617 issued in the names of the petitioner and his brother. According to the petitioner, as per the Village FMB sketch, the description of the property is not correctly mentioned. 4. No prejudice would be caused to the respondents, if the petitioner's representation dated 09.04.2022 is considered on merits and in accordance with law after affording a fair hearing to the petitioner and any other necessary party, whom the second respondent deems fit to enquire.

For the foregoing reasons, this Court directs the second respondent to consider the petitioner's representation dated 09.04.2022 seeking for correction of the Village FMB sketch for the property comprised in Survey No.859/1A, Ponnusangampatti Village, Thuraiyur Taluk, Trichy District in terms of Joint Patta No.617 issued in favour of the petitioner and his brother and pass final orders on merits and in accordance with law, after affording a fair hearing to the petitioner and any other necessary party, whom the second respondent deems fit to enquire, including granting them the right of personal hearing, within a period of twelve (12) weeks from the date of receipt of a copy of this order.

6. With the aforesaid direction, this Writ Petition is disposed of. There shall be no order as to costs.
