For Respondent : Mr.S.Ravi, Standing Counsel for Government PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.384 of 2020 on the file of the respondent Police.

ORDER : The Court made the following order :- The petitioner/Accused, who apprehends arrest at the hands of the respondent police for the alleged offence under Sections 353 and 379 of IPC and Section 21(1) of Mines and Minerals (Development and Regulation) Act, 1957, in Crime No.384 of 2020, seeks anticipatory bail.

2.The case of the prosecution is that on 10.12.2020, at about 09.20 p.m., the petitioner and others were found in illegal possession of two untis of river sand. Hence, the complaint. 3.The learned counsel for the petitioner would submit that this is the fifth anticipatory bail application. He would further submit that the petitioner is an innocent person and he is a senior citizen. On that ground, he seeks anticipatory bail to the petitioner.

4. The learned Standing Counsel for Government appearing for the respondent would submit that the petitioner is having one previous case and therefore, he vehemently opposed to grant anticipatory bail to the petitioner.

5. It is seen that the petition filed by the petitioner in Crl.OP(MD)No.1527 of 2020 was dismissed by this Court on merits, following the order passed in Crl.OP.No.13334 of 2020 etc., batch, dated 03.09.2020, by the Principal Bench of this Court. Later, the successive applications came to be filed before me and those applications were dismissed. This is the fifth application filed by the petitioner on the ground that he is a senior citizen and he is not involved in this case and had no bad antecedents. 6.Considering the above facts, I find no merits in this petition. Hence, this Court is not inclined to grant anticipatory bail to the petitioner.
