Respondents PRAYER: Habeas Corpus Petition has been filed under Article 226 of the Constitution of India, praying to issue a Writ of Habeas Carpus directing the respondents 1 and 2 to secure G.Sharmila, aged about 19 years, who is the petitioner's daughter, from the illegal custody of the 3rd respondent and produce her before this Court and set her at liberty.

ORDER

[Order of the Court was made by R.SUBBIAH, J.] The father of the detenu by name Sharmila, aged about 19 years, has come up with this Habeas Corpus Petition alleging that the third respondent herein has illegally abducted her. In this regard, he has already given a complaint to the second respondent Police and the second respondent has also registered a case in Crime No.89 of 2017 for woman missing. Thereafter, there was no response to the same. Hence, he has come up with this petition. https://hcservices.ecourts.gov.in/hcservices/ 2.Today, when the matter was taken up for hearing, the detenu was produced before this Court by the second respondent Police.

When we enquired, the detenu told that she has not been abducted by anybody and that since her father had suspicion over her activity, she, on her own volition, left the house and went to a friend house at Tirupur and she was working there. She has further told that she is willing to join with her father viz., petitioner. The said statement is recorded.

3.In view of the above, nothing survives for adjudication in this petition. Hence, this Habeas Corpus Petition is closed with liberty to the detenu to choose her own way of life.
