Respondents PRAYER : Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus to call for the records pertaining to the impugned minutes of Peace Committee Meeting held by the third respondent on 30.03.2023 and quash the same as illegal, consequently directing the third respondent to direct the respondents 6 to 10 to conduct Panguni Uthiram festival scheduled on 05.04.2023 in Sri Murugan, Sri Chellandiamman and Sri Mariamman situated at Arjunan Nagar, Mela Kalkandarkottai, Trichy District, after following the minutes of last year Peace Committee Meeting passed by the third respondent on11.03.2022.

The writ petition is disposed of at the admission stage itself even without issuing notice to the respondents 6 to 10 who are private individuals. Mr.N.Muthu Vijayan, learned Special Government Pleader had taken notice on behalf of the respondents 1 to 5.

The writ petitioner had come to Court earlier by filing W.P.(MD) No.6380 of 2023, wherein, with respect to the very same function namely, Panguni Uthiram festival to be held on 05.04.2023 in the very same temple, Sri Chellandiamman and Sri Mariamman situated at Arjunan Nagar, Mela Kalkandarkottai, Trichy District, it had been stated that necessary procedure had not been followed as decided in the Peace Committee Meeting.
3. Let me not prevaricate the issue any further but take on record, the instructions stated by the learned Special Government Pleader that a Peace Committee Meeting had been conducted on 30.03.2023, 3/7
wherein the petitioner also specifically participated. It is fervently hoped that the petitioner and the other private respondents would focus on the festival being completed on 05.04.2023. On the dates, when the deity has no festival, and when everybody has forgotten the deity, they may re-start their quarrels, but not on the one day when there is some function performed for the sake of the deity. If they have some interest in the deity, they would permit that one day to be celebrated for and on behalf of deity, and put aside their quarrels. They can start quarrelling on all those dates when there is no function at all.
4. I am not prepared to pass any orders. The learned counsel states that accounts have to be produced and that accounts have not been produced. These are issues which are beyond the scope of this Court.
5. Accordingly, the writ petition is dismissed. No orders are passed, since it is the second writ petition on the very same cause. A direction is given that not only the petitioner but everybody must be permitted to participate in the function rather/ worship the deity on the 4/7
specific dates. No costs. Consequently, connected miscellaneous petitions are closed.
