Respondents PRAYER: Petition filed under Article 226 of the Constitution of India to issue a writ of Habeas Corpus directing the respondents 1 to 4 to produce the person or body of the detenu, Srivilliputtur Constituency Member of Legislative Assembly, namely, Mrs.Chandra Prabha, wife of Muthiah, aged 35 years, now detained by the fifth respondent herein before this Court and set her at liberty. ORDER
(Order of the Court was made by T.S.SIVAGNANAM,J.) This petition has been filed by one Analagan, who claims himself that he belongs to a particular political party and sought a direction to produce the detenu, who is the Member of Legislative Assembly of Srivilliputtur Constituency.
2. The petitioner appears to have got inspiration to file this petition based on Press reports. There is no averment in the affidavit that he has any personal knowledge of the detenu being detained against her will nor there is any material to show that the detenu was detained forcibly.
3. The learned Additional Public Prosecutor appearing for the respondents 1 to 4, on instructions, would submit that this petition itself was filed only for cheap publicity.
4. Be that as it may, all the Members of the Legislative Assembly have appeared before the Tamil Nadu State Assembly and have also participated in the Budget Sessions and hence, there is no illegal detention of the detenu. Hence, this Habeas Corpus Petition is dismissed.
