Respondents PRAYER :- Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents 3 to 11 herein to conduct appropriate enquiry on the erroneous registration of death of the petitioners son Jameenraj who is unmarried person till his demise i.e., on 04.01.2023, but wrongly entered the 12th respondents name Shanmugapriya in the wife column and to issue fresh death certificate after making necessary corrections by removing the name of 12th respondent / Shanmugapriya in the husband / wifes name column in the Register of Births and Deaths kept in the 9th and 10th respondents office by considering the petitioners representation 28.08.2024 within a stipulated time that may be fixed by this Court. ORDER

The petitioner is before this Court seeking a direction to respondents 3 to 11 to conduct an enquiry regarding the alleged erroneous registration of the death of the petitioner's son, Jameenraj.

2. The petitioner states that his son, Jameenraj, died on 04.01.2023, and a death certificate was issued by the 9th respondent. In the said death certificate, the 12th respondent has been shown as the wife of the deceased. The petitioner contends that the deceased was unmarried and, therefore, submitted a representation seeking cancellation of the death certificate. The third respondent, in turn, forwarded the said representation to the fifth respondent in terms of Sub-Rule (4) of Rule 9 of the Tamil Nadu Registration of Births and Deaths Rules, 2000. The grievance of the petitioner is that the fifth respondent has not taken any steps to consider the said representation.

3. The learned Government Advocate (Crl. Side), on instructions, submitted that the fifth respondent would consider the petitioner's 4/7

representation in accordance with law within a time frame to be stipulated by this Court.

4. The said submission is placed on record. Accordingly, this writ petition is disposed of with a direction to the fifth respondent to consider the petitioner's representation dated 28.08.2024, on its own merits and in accordance with law, after issuing notice to the 12th respondent, and to pass appropriate orders.

5. The above exercise shall be completed within a period of two

(2) months from the date of receipt of a copy of this order. There shall be no order as to costs.
