ORDER : The Court made the following order :- The petitioner/accused who was arrested on 25.03.2021 for the offences punishable under Section 363 IPC and Section 5(1) r/w Section 6 of Protection of Children from Sexual Offences Act, 2012 in Crime NO. 91 of 2021 on the file of the respondent police, seeks bail.

2. Heard the learned counsel for the petitioner and the learned Government Advocate(Crl.side) appearing for the respondent police.

3. The case of the prosecution is that the daughter of the defacto complainant was kidnapped by the petitioner/accused and the petitioner had sexual intercourse with her.

4. The learned counsel for the petitioner would submit that a false complaint has been lodged against the petitioner and the petitioner has been in judicial custody from 25.03.2021 and therefore, he seeks bail.

5. The learned Government Advocate would submit that in this

case, Section 164 Cr.P.C statement has been recorded and they await for the same. He would further submit that investigation is at preliminary stage.

6. Considering the gravity of the offences and considering the fact that investigation is at preliminary stage, this Court is not inclined to grant bail to the petitioner. Hence, this petition is dismissed.
