For Respondent : Mr.K.Suyambulinga Bharathi, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No. 1 of 2020 on the file of the Respondent Police ORDER : The Court made the following order :- The petitioner who is arrayed as A-3 apprehending arrest at the hands of the respondent police for the offences punishable under sections 120B, 406 & 420 of IPC r/w Section 5 of TANPID Act, in Crime No.1 of 2020 on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution is that the petitioner is one of the Directors of the finance institution, namely; Jesus Mercy Enterprises. The allegation against the petitioner is that he along with other accused have collected huge amount from the depositors and thereafter, failed to repay the amount. Hence, a complaint has been registered.

4. The learned counsel appearing for the petitioner would submit that A-1 & A-2 already released on bail on condition to deposit a sum of Rs.2 Lakhs. Hence, he seeks anticipatory bail.
5. The learned Government Advocate (criminal side)appearing for the respondent police would submit that investigation is still pending and complaints have been received from the depositors and so far as this petitioner is concerned more than Rs.3 Crores has been transferred to the petitioner's account.
6. Taking note of the submission of the learned Government Advocate (criminal side) and considering the fact that investigation is still pending and complaint is being received from the depositors and huge amount has been transferred to the petitioner's account and hence, this Court is not inclined to grant anticipatory bail.
7. Accordingly, the Criminal Original Petition stands dismissed.
