PRAYER: This petition is preferred under Section 482 Cr.P.C., to direct III Additional District and Sessions (PCR) Court, Madurai to consider the petitioner's application to recall the Non-Bailable Warrant dated 09.03.2016 issued against him in S.S.C.No.59 of 2015 on the file of III Additional District and Sessions (PCR) Court, Madurai, on the same day of his surrender.

O R D E R

The petitioner has filed this criminal original petition, under Section 482 of the Code of Criminal Procedure, to direct III Additional District and Sessions (PCR) Court, Madurai to consider the petitioner's application to recall the Non-Bailable Warrant dated 09.03.2016 issued against him in S.S.C.No.59 of 2015 on the file of III Additional District and Sessions (PCR) Court, Madurai, on the same day of his surrender.

2. Heard the learned Counsel appearing for the petitioner and the learned Government Advocate (Crl.Side) appearing for the State.

3. It is seen that this petitioner did not appear before the trial Court on 09.03.2016 on account of which Non-Bailable Warrant was issued for his presence on 24.03.2016. It is seen that the petitioner has been regularly appearing before the trial Court in the previous hearings.

4. Under such circumstances, the petitioner is directed to surrender before the learned III Additional District and Sessions (PCR) Court, Madurai on or before 24.03.2016 and file an application for recalling of warrant, which shall be considered by the learned III Additional District and Sessions (PCR) Court, Madurai on the same day. With the above directions, this Criminal Original Petition is disposed of.
