O R D E R

[Order of the Court was made by N.ANAND VENKATESH, J.] This writ petition has been filed for the issue of writ of mandamus directing the respondents to consider the representation dated 14.12.2025 made by the petitioner, wherein, the petitioner is seeking for premature release of his father, who is presently confined at Central Prison, Madurai.

2. The petitioner's father is a life convict and he has undergone sentence for more than 14 years. Earlier, a representation was made seeking for premature release and the same was placed before the Advisory Board under Rule 341 of the Tamil Nadu Prison Rules, 1983. The Advisory Board recommended for premature release and the file was

placed before the first respondent. However, the first respondent through the proceedings dated 02.06.2025 rejected the request. Aggrieved by the same, a writ petition was filed before this Court in W.P.Crl.(MD).No.323 of 2025. This writ petition was disposed of by an order dated 01.12.2025 by giving liberty to the petitioner to submit a fresh representation seeking premature release as per the amended Tamil Nadu Suspension of Sentence Rules, 2024 to the second respondent. Pursuant to the above order, the petitioner submitted a representation dated 14.12.2025 to the third respondent. According to the petitioner, the third respondent has forwarded the same with a report to the first and second respondents and thereafter, there was no development. It is under these circumstances, the present writ petition came to be filed before this Court.

3. Heard the learned counsel on either side.

4. Taking into consideration the facts and circumstances of the case and also the records placed before this Court and without going into the merits of the case, there shall be a direction to the first respondent to act upon the representation made by the petitioner on 14.12.2025 on its own

merits and in accordance with law and take a decision within a period of eight weeks from 01.07.2026.
