ORDER
This Civil Miscellaneous Petition has been filed to condone the delay of 318 days in filing the Appeal Suit in A.S.(MD)SR No.23957 of 2026 before this Court.
2. Heard the learned counsel appearing on either side and perused the affidavit filed in support of this petition as well as the counter affidavit filed by the respondent.
3. The learned counsel for the respondent raised objections to this petition, contending that the reasons stated in the affidavit are not convincing.
4. Upon perusal of the affidavit, this Court finds that sufficient reasons have been stated in Paragraph No.11 thereof. 2/4
5. Being satisfied with those reasons stated in the affidavit, this Court is inclined to allow this petition on payment of costs. Accordingly, this Civil Miscellaneous Petition is allowed on payment of costs of Rs. 5,000/- (Rupees Five Thousand only) by the petitioner to the respondent, within a period of ten (10) days from the date of receipt of a copy of this order, failing which this petition shall stand automatically dismissed without any further reference to this Court. 24-06-2026 mkn 3/4
