RESPONDENTS/PETITIONERS (2nd RESPONDENT IS MINOR REPRESENTED BY HIS MOTHER AND NATURAL GUARDIAN 1ST RESPONDENT) Petition filed praying that in the circumstances stated therein and in the petition filed therewith the High Court may be pleased to stay the all further proceedings in pursuant to the order passed in MC.No.2/2019, dated.29.06.2020 on the file of the Learned Family Court, Karur, pending disposal of the above Criminal Original Petition.
Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of MR.R.MATHIYALAGAN, Advocate for the petitioner and of MR.RMS.SETHURAMAN, Advocate on behalf of the Respondents, while admitting the Crl.RC., the Court made the following order:- This petition has been filed to stay the further proceedings of the order in M.C.No.2 of 2019, dated 29.06.2020, on the file of the Family Court, Karur, till the disposal of the Criminal Revision Case.
2.On the side of the petitioner, it is stated that the petitioner/ husband is willing for reunion and prayed the case to be referred to the Mediation.
3.On the side of the respondents, it is stated that though the order was passed in the month of June - 2020 itself, the petitioner has not paid any amount for the maintenance of the first respondent / wife as well as the second respondent / minor child. https://hcservices.ecourts.gov.in/hcservices/ 1/2
CRL MP(MD) No.3817 of 2020 4.In view of the facts of the case, this Court directs the petitioner to deposit 50 % of the arrears amount within a period of one month from today (i.e.21.01.2021) and the petitioner is further directed to pay 50 % of the monthly maintenance amount on or before fifth of every month. Failing which, the respondent is at liberty to take further action in accordance with law.
