Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner/Accused No.2 apprehending arrest at the hands of the respondent police for the offences punishable under Sections 294 (b), 323, 324, 506(ii) of IPC, in Crime No.107 of 2018, seeks anticipatory bail.

2.Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) for the respondent. 3.The defacto complainant is none other than the petitioner's Aunt. In respect of the property dispute, the petitioner and his father had assaulted the defacto complainant and her husband. The defacto complainant's husband suffered head injury and still in hospital. The learned counsel appearing for the petitioner on instructions to the petitioner, undertakes to deposit sum of Rs.2,000/- (Rupees Two Thousand only) into the Crime No.107 of 2018 before the Jurisdictional Magistrate. It is open to the defacto complainant to withdraw the said amount. The respondent police is directed to intimate the same to the defacto complainant. 4.

Taking into account of these circumstances and subject to the above specific condition, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned District https://hcservices.ecourts.gov.

Munsif-cum-Judicial Magistrate, Rameswaram, Ramanathapuram District and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police as and when required for interrogation. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C. scrupulously.

5.The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
