O R D E R
This Writ Petition has been filed seeking to quash the impugned order passed by the first respondent in Na.Ka.No. 17/Misc/W1 L and O / Ps/MC/2025 dated 31.03.2025 and to give permission for Aadal Paadal function scheduled on 06.04.2025 and adequate protection for the temple festival of Arulmighu Muthu Mariyamman Temple Thiruvalluvar Nagar, Thanakankulam, Thirunagar, Madurai.
2.According to the petitioner, he is the one of the members of the vizha committee of the said temple and the villagers decided to conduct festival from 28.03.2025 to 07.04.2025 and also decided to conduct Adal Padal programme on 06.04.2025, for that they approached the third 2/6
respondent for grant of permission and the same was rejected on the ground of law and order issue. There is no chance for law and order issue as alleged by the third respondent and no such incident was occurred in the previous years and the villagers used to conduct festival and cultural programmes for the past fifty years and no any untoward incident had taken place in the previous years. The petitioner also undertakes to conduct the festival and cultural programme without any law and order issue. Therefore, the impugned order is liable to be quashed.
3.The learned Additional Public Prosecutor appearing for the respondent police would submit that the petitioner sent the representation, dated 17.03.2025 for conducting Adal Padal programme on 06.04.2025 and the same was rejected on the ground of law and order issue. Therefore, this petition is liable to be dismissed. 4.Heard both sides and perused the records.
5.The petitioner and the other villagers have decided to conduct the festival from 28.03.2025 to 07.04.2025. While so, they decided to 3/6
conduct Adal Padal programme on 06.04.2025, for which, permission was declined on the ground of law and order issue. There are no records to show that in the earlier festivals, law and order issue arose. Therefore, rejecting the representation on the sole ground of law and order issue is not acceptable. Therefore, the impugned order is liable to be quashed.
6.Accordingly, the impugned order is quashed and this writ petition is allowed with a direction to the third respondent to grant permission for conducting Adal Padal programme on 06.04.2025 by imposing certain conditions and also to ensure the law and order and supervise the entire events.
