: Mr.P.Durai Pandi C O M M O N O R D E R These Criminal Original Petitions have been filed seeking to quash the final report in S.C.No.70 of 2023 on the file of the Principal District and Sessions Court, Ramanathapuram, filed against the petitioners for the offences punishable under Sections 435, 120B, 109 and 452 of the Indian Penal Code, 1860 and Section 4 of the Tamil Nadu Public Property (Prevention of Damage and Loss) Act, 1992.

2. The allegation in the final report is that, on account of prior enmity, the petitioners, along with A1, caused damage to the property belonging to the second respondent/defacto complainant.

3. The learned counsel for the petitioners would submit that the case against the first accused was quashed by this Court on merits in Crl.O.P.(MD) No.12137 of 2022, vide order dated 13.06.2023, and that Page No. 2 of 13

the parties have now entered into a compromise and decided to give a quietus to the entire dispute.

4. Admittedly, the petitioners and the second respondent belong to the same village. The parties have now entered into a compromise and decided to give a quietus to the entire dispute. 4. The petitioner in Crl.O.P.(MD) No.6624 of 2025, namely, Manikandan [Aadhaar No.3320 3323 1331] and the petitioners in Crl.O.P. (MD) No.10005 of 2025, namely, (1) Ananth @ Anandan [Aadhaar No. 7334 5227 2055] and (2) Kaleeshwaran @ Kalesswaran [Aadhaar No. 7056 1790 2692], and the second respondent/defacto complainant, namely, Vincent Raja [Aadhaar No.7136 9067 2478] are present before this Court in person. The parties are identified by Mr.V.Dinakaran, Special Sub Inspector of Police, Paramakudi Taluk Police Station, Ramanathapuram District. All the parties confirmed the compromise arrived at between them.

In view of the same and considering the nature of the offences and the relationship between the parties, this Court is of the view that no useful purpose would be served by keeping the impugned final report pending trial. Accordingly, the impugned final report in S.C.No.70 of 2023 on the file of the Principal District and Sessions Court, Ramanathapuram, is quashed. The petitioners shall pay a sum of Rs.5,000/- as costs to the Mediation and Conciliation Centre attached to the Madurai Bench of Madras High Court forthwith and file a photocopy of the receipt along with a memo reporting compliance in the Registry.
