O R D E R

This Writ Petition has been filed to direct the 2nd respondent to issue Non - Traceable Certificate in respect of Document viz, Original Deed in Document No. D.No. 98/1979 on the file of the Manamadurai Sub Registrar based on petitioner's complaint pending in CSR No. 1388 of 2024 dated 03.11.2024.

2.According to the petitioner, the father of the petitioner is the owner of the property in S.No.78/9, Melapasalai and the same was registered in Document No. D.No. 98/1979 on the file of the office of Manamadurai Sub Registrar. After the death of his father, the document was under the custody of the petitioner. While so, on 03.10.2024, the petitioner has carried the document for taking photocopies, thereafter, he was waiting in the Manamadurai bus stand. At that time, the said document was misplaced. In this regard, the petitioner has lodged a complaint on 03.10.2024 and the respondent police has also assigned CSR No.1388 of 2024, thereafter, no action has been taken by the respondent police. Hence, this petition.

3.The learned Additional Public Prosecutor appearing for the respondent Police would submit that they have received the complaint of the petitioner and the same is under enquiry, however the petitioner has not enclosed the relevant documents. If the petitioner appear before the respondent police for enquiry, they will act in accordance with law.

4.Considering the prayer of the petitioner and recording the submission of the learned Additional Public Prosecutor, this Court hereby directs the petitioner to appear before the 2nd respondent on 12.04.2025 along with necessary documents, thereafter, the 2nd respondent shall conduct enquiry and dispose the same within a period of 15 days from the date of this order in accordance with law. 5.With the above observations and directions, this Writ Petition is disposed of.
