PRAYER:Writ Petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus, directing the second respondent to pay back wages for the period of 13 years from 01.08.19998 to 06.07.2011, PRP (Performance Related Pay) for 10 years from 2011 to 2020 and annual increment from 2011 to 2020 with all consequential benefits to the petitioner for 1/4

the service rendered by her deceased husband by taking note of the first respondent's proceedings No.24824/CV-3/2000-48, dated 22.01.2021 within a stipulated time.

ORDER

(Order of the Court was made by J.NISHA BANU, J.) Heard Mr.T.Aswin Raja Simman, learned counsel for the petitioner, Mr.M.Sarangan, learned Additional Government Pleader for the first respondent. Considering the nature of the order proposed to be passed in this writ petition, notice to the second respondent is dispensed with. 2.By consent, this writ petition is taken up for final disposal at the stage of admission itself.

3.The petitioner's husband was the employee of the respondent Corporation. He joined in service in the year 1977. Since the community certificate obtained by the petitioner was cancelled, he was placed under suspension in the year 1998. After several round of litigation, the petitioner was 2/4

reinstated in service in the year 2011. Thereafter, in the year 2020 , the petitioner's husband died, while he was in service. His request for annual increment, performance related pay and the back wages for the period of his suspension was not considered during his lifetime. Therefore, the petitioner made a representation before the respondent seeking all the above benefits. 4.Bearing in mind the facts and circumstances of the case, this Court directs the respondents to settle the entire benefits, to which the petitioner's husband is entitled, to the petitioner within a period of twelve weeks from the date of receipt of a copy of this order.

5.With the above direction, this writ petition is disposed of. No costs. (J.N.B.,J.)
