Writ Petitions are filed under article 226 of the Constitution of India, praying to issue a Writ of Certiorarified Mandamus, calling for the records comprised in P/I-Joint Sub Registrar Pudukkottai/126/2026 dated 06.03.2026 on the file of the respondent and quash the same as arbitrary and illegal and consequently, direct the respondent to register and release the sale deed in Doc.No.TP/257274002/2026 dated 06.03.2026 kept pending in P/I-Joint Sub Registrar Pudukkottai/126/2026 forthwith. ORDER

This writ petition is filed challenging the impugned order dated 06.03.2026 on the file of the respondent.

2.By the impugned order, the document of the petitioner was directed to be kept pending and the same is not registered. 3.When the matter came up for hearing, the learned Special Government Pleader appearing on behalf of the respondent on written instructions would submit that since the document is undervalued, the same is being withheld. Even if the Sub Registrar is of the opinion that there is undervaluation, the document has to be registered and further, the matter has to be referred to the appropriate authority as per Section 47-A of the Stamp Act. Therefore, keeping open the said liberty, the Sub-Registrar to take further steps in accordance with law, the writ petition is allowed on the following terms:

(i)The impugned proceedings dated 06.03.02026 shall stand set aside. It will be open for the sub registrar to register the document and further refer the matter in the manner known to law. No costs. Consequently, connected miscellaneous petition is closed.
