ORDER
(Order of the Court was made by J. NISHA BANU, J.) By consent of both parties, this Writ Petition is taken up for final disposal at the stage of admission itself. Considering the limited relief sought for by the petitioner, notice to the fourth respondent is dispensed with. 2.According to the petitioner, the fourth respondent has obtained an assignment patta by submitting false statement before the third respondent. The fourth respondent is residing in his own house in Survey No.49/50 situated at T.Andipatti, Aalampatti Village, Thirumangalam Taluk and also owns land comprised in Survey No.80/14 at Chettipillayarnatham Village, Thirumangalam Taluk, Madurai District. Further, according to the petitioner, free assignment of house site is given to those whose annual income is below Rs.16,000/- in rural areas and Rs.24,000/- in urban areas. Hence, the fourth respondent is not entitled to receive a free house site patta from the Government. In this regard, the 2/6
petitioner submitted a representation to the respondents on 02.02.2024. As the same has been kept pending without any progress, the petitioner has filed this Writ Petition seeking the aforesaid relief.
3.The learned Government Pleader appearing for the respondents 1 to 3 submits that the representation of the petitioner will be considered and appropriate orders will be passed on its own merits within a time frame to be stipulated by this Court.
4.Considering the limited scope of the prayer sought for by the petitioner and without expressing any opinion on the merits of the claim made by the petitioner either in the representation or in the affidavit filed in support of this Writ Petition, we direct the respondents 1 to 3 to consider the representation of the petitioner dated 02.02.2024, after affording sufficient opportunity of personal hearing to both the petitioner and the fourth respondent and pass appropriate orders on merits and in accordance with law within a period of twelve (12) weeks from the date of receipt of a copy of this order. 3/6
5.With the above direction, this Writ Petition is disposed of. There shall be no order as to costs.
