PRAYER :- For Bail in Crime No.367 of 2020 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner/2nd Accused, who was arrested on 29.07.2020 for the offence punishable under Section 8(c) r/w. 20(b)(ii)(B), 25, 29(1) of Narcotic Drugs & Psychotropic Substances Act, 1985 in Crime No.367 of 2020, on the file of the respondent police, seeks bail. 2.Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the respondent police. 3.The case of the prosecution is that on routine rounds, the petitioner along with other accused were found to be in possession of ganja weighing about 14 kgs.

4.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he had no knowledge about the type of material that was transported in his vehicle and therefore, he seeks bail.

5.The learned Additional Public Prosecutor, on instructions, submitted that the quantity involved in the present case is a commercial quantity and the bail application of the co-accused has been dismissed by this Court on 30.04.2021. He further submitted that a charge sheet as been filed in C.C.No.126 of 2020. Therefore, he opposes this petition.

6.Considering the fact that the quantity involved is a commercial quantity, this Court is not inclined to grant bail to the petitioner. Accordingly, this criminal original petition is dismissed.
