O R D E R

Heard Mr. P. Ganapathi Subramanian, learned counsel appearing for the petitioner, and Mr. M. Mahaboob Athiff, learned Government Advocate, who accepts notice on behalf of respondents 1 and 2. Notice to the third respondent is dispensed with in view of the order proposed to be passed.

2.The petitioner is before this Court seeking issuance of a Writ of Mandamus directing the second respondent to conclude the enquiry initiated pursuant to the petitions submitted by the petitioner dated 06.05.2024 and 23.10.2024.

3.The petitioner, a senior citizen, has invoked Section 23 of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, seeking cancellation of the Settlement Deed dated 18.07.2019 executed in favour of her son, namely, the third respondent. According to the petitioner, representations in this regard were submitted on 06.05.2024 and 23.10.2024. The grievance of the petitioner is that, despite the lapse of considerable time, the second respondent has not concluded the 2/5

enquiry or passed final orders on the said petitions. 4.Mr. M. Mahaboob Athiff, learned Government Advocate appearing for respondents 1 and 2, on instructions, submitted that the petitions dated 06.05.2024 and 23.10.2024 would be considered and disposed of by the second respondent on their own merits within such time as may be stipulated by this Court. The said submission is placed on record.

5.In view of the above submission, and without expressing any opinion on the merits of the petitioner's claim, this Court deems it appropriate to direct the competent authority to conclude the proceedings within a time-bound manner.

6.Accordingly, the writ petition stands disposed of with a direction to the second respondent to consider and dispose of the petitions submitted by the petitioner dated 06.05.2024 and 23.10.2024, on their own merits and in accordance with law, after affording a reasonable opportunity of hearing to the petitioner, the third respondent, and all 3/5

other persons likely to be affected by the decision. 7.The aforesaid exercise shall be completed within a period of eight (8) weeks from the date of receipt of a copy of this order. 8.There shall be no order as to costs.
