PRAYER: Criminal Original Petition filed under Section 482 of Cr.P.C., praying to direct the learned Principal District and Sessions Judge, Karur to accept his surrender and to consider his bail application in Crime No.493 of 2023 on the file of 2nd respondent police to be filed by the petitioner. The petitioner is accused in Crime No.493 of 2023 on the file of the second respondent police. The said case was registered for the offence under Sections 294(b), 324 and 506(ii) of IPC and Sections 3(1)(r), 3(1)(s) and 3(2)(va) of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 2015.
2.The learned Government Advocate (Crl. Side) appearing for the respondent police submitted that this Court by earlier order dated 11.10.2023 has granted relief to the petitioner with a direction to surrender before the learned Principal District and Sessions Judge, Karur, within a period of 15 days from the date of receipt of a copy of the order, but the petitioner has not complied with the same. Thereafter he filed an application for an extension of time and the same was allowed by order dated 13.02.2024. However, the petitioner has not utilized the relief granted by this Court. Thereafter the petitioner has filed another application in Crl.M.P.(MD)No.857 of 2024 and the same was also allowed by this Court by stating that if the petitioner does not surrender before the Court 2/4
concerned, no further extension of time would be granted to the petitioner. Therefore, the petitioner has filed this application seeking a direction afresh to the learned Principal District and Sessions Judge, Karur, to accept his surrender and to consider his bail application in Crime No.493 of 2023 on the file of 2nd respondent police.
3.Considering the conduct of the petitioner in filing the petitioner one after the other without complying with the direction, this Court is not inclined to entertain this application. Accordingly, this Criminal Original Petition is dismissed with liberty to the petitioner to appear before the trial Court.
