PRAYER :- For Bail in Crime No.178 of 2021 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner/A1, who was arrested and remanded to judicial custody on 28.03.2021 for the offences punishable under Sections 174 Cr.P.C @ 306,207 of IPC in crime No.178 of 2021 on the file of the respondent police, seeks bail.

2.The case of the prosecution is that due to family dispute between the petitioner and the deceased consumed rat poison mixed with cool drinks and also gave to her child. Hence, the complaint. 3.The learned counsel for the petitioner would submit that the petitioner is innocent and he has been falsely implicated in this case. He would further submit that the deceased is the wife of the petitioner and the defacto complainant is the mother of the deceased. He would also submit that the petitioner is in judicial custody from 28.03.2021, hence he may be granted bail. 4.The learned Government Advocate(Crl.Side) would submit that the investigation is still pending and awaiting for post mortem report and lab report. CRL OP(MD). No.6616 of 2021 is not yet completed, hence he opposed to grant bail to the petitioner.

5. Taking into consideration the facts and circumstances of the case and also the fact that the investigation is in the preliminary stage and also awaiting for post mortem report and lab report, this Court is not inclined to grant bail to the petitioner at this stage.

6. Hence the petition stands dismissed.
