PRAYER: Criminal Original Petition filed under Section 482 Cr.P.C. praying to transfer the investigation of Crime No.515 of 2021 from the file of 2nd respondent to some other unbiased police or competent agency to conduct fair and impartial investigation in accordance with law.

ORDER

This petition has been filed seeking direction to transfer the investigation of Crime No.515 of 2021 from the file of 2nd respondent to some other unbiased police or competent agency to conduct fair and impartial investigation in accordance with law.

2. The learned counsel for the petitioner would submit that the first accused is working as police constable and as such the second respondent failed to secure the accused and keep the First Information Report pending.

3. The learned Additional Public Prosecutor would submit that the investigation is under progress and about to complete the investigation.

4. Under such circumstances, if the investigation is transferred to file of the any other agency it will affect the entire investigation done by the second respondent.

5. In view of the same, the second respondent is directed to follow the procedure and complete the investigation and file the final report within a period of twelve weeks from the date of receipt of a copy of this order. Further the first respondent is directed to monitor the investigation done by the second respondent. https://hcservices.ecourts.gov.in/hcservices/

6. With the above direction, the Criminal Original Petition stands disposed of.
