: Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus to direct the respondent to issue patta in favour of the petitioner for the property comprised in old Survey No.245/1, New Survey No.527/1, to an extent of 20 cents situated at Thelungupatti, Porunthulur Village, Thogaimalai Post, Kulithalai Taluk, Karur District by considering the petitioner's representation dated 16.12.2024 within a stipulated period that may be fixed by this Court.

O R D E R

The petitioner has sought for issuance of Writ of Mandamus, to direct the respondents to issue patta. The petitioner has made an application in this regard on 16.12.2024. 2.The petitioner also has disclosed in the affidavit in support of the writ petition that there was a civil litigation between the petitioner and other legal heirs and the petitioner has succeeded in the said cases. In fact, it is also noticed that the Tahsildar, himself has been arrayed as 11th defendant in O.S.No.195 of 2019, which has been filed by an adversary party. The said suit came to be dismissed on 07.06.2024. Therefore, there can be no impediment for the respondent to consider the petitioner's application for issuance of patta.

3.However, learned Special Government Pleader, submits on instructions, that the respondent has fixed that survey of the petitioner's property as a preliminary stage for considering the petitioner's application for issuance of patta and such survey is proposed to be undertaken on 09.04.2025.

4.Considering the above developments, it would suffice to direct the respondent to complete the survey and pass final orders within a period of eight [8] weeks from the date of receipt of a copy of this order.

5.Accordingly, this Writ Petition is disposed of. There shall be no order as to costs.
