Respondents Prayer: Writ petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents herein to release the petitioner's SCORPIO car bearing registration No.TN 81-Y-9595 within the time stipulated by this Court by imposing such conditions as this Court may deem fit and proper in the circumstances of the case.

O R D E R

Heard the learned counsel on either side. By consent of both parties, this writ petition is taken up for final disposal at the admission stage itself.

2. This writ petition has been filed seeking release of the petition mentioned vehicle.

3. The vehicle in question was involved in a case under the Tamil Nadu Prohibition Act. The petitioner's counsel fairly informed this Court that the vehicle in question has since been confiscated. Therefore, the only remedy open to the petitioner is to move the jurisdictional Court by filing an appeal as laid down in the statute. It is not possible for this Court to grant relief to the petitioner.

4. The petitioner's rights are left open. I make it clear that I have not gone into the merits of the matter. The concerned Sessions Judge shall dispose of the petitioner's application or appeal as early as possible.

5. With these observations, this writ petition stands dismissed. No costs.
