ORDER

This Criminal Original Petition has been filed for issuing a direction to the 1st respondent to direct the 2nd respondent not to harass the petitioner by interfering the civil dispute between the petitioner and the 3rd respondent based on the representation made by the petitioner, dated 28.03.2023.

2. It appears that the third respondent has given a complaint against the petitioner and the same was registered in Crime No.88 of 2021 for the offence under Section 294(b), 434 and 506(ii) IPC. Pending the above said investigation, it appears that the petitioner herein has also given a complaint against the third respondent and others which is also enquired in Petition No.92 of 2023.

3. Now, the grievance of the petitioner is that when the construction was put up in the property belonging to him, the third respondent with the help of others making trouble and hence, he has 2/5

given a complaint. He further stated that the respondent police are harassing the him based on the complaint given by the third respondent.

4. Since the petitioner himself given a complaint against the third party the question of harassment is contradictory and hence, this petition cannot be entertained. I do not find any reason to entertain this petition. The petitioner is directed to appear before the respondent police and co-operate with enquiry.

5. Accordingly, this Criminal original Petition is dismissed. 06..04.2023 NCC :
