ORDER

This Criminal Original Petition has been filed for issuing a direction to the 3rd respondent not to harass the petitioner without following the due process of law.

2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the respondent police.

3. On perusal of the records shows that originally on the basis of the complaint given by the mother of the third respondent enquiry was undertaken and during the course of enquiry, it was found that the house property mentioned in the complaint is in dilapidated condition and it is also not a fit place for occupation and there is no possibility for theft and hence, the same was closed on 08.07.2022.

4. Aggrieved over the closure of the said complaint the mother of the third respondent approached the Deputy Inspector General of Police, 2/5

Southern Region and that was forwarded to the second respondent police again on 13.02.2023. When the fresh enquiry has been ordered by the higher authority, during the course of enquiry, it was found that in respect of the above said house property, suit is also pending between the parties. The respondents police may make fresh enquiry for that both the petitioner and the third respondent shall co-operate with them. Depending upon the out come of the enquiry, they shall work out their remedy through appropriate proceedings.

5. With the above direction, this Criminal original Petition is disposed of.
