PETITION FOR ANTICIPATORY BAIL Under Section 438 of Cr.P.C. PRAYER :- For Anticipatory Bail in Crime No.13 of 2022 on the file of the Respondent police.

ORDER : The Court made the following order :- The petitioner/Accused, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 417, 376(i) IPC, in Crime No.13 of 2022, on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution is that the petitioner and the defacto complainant were in love and the petitioner by giving false promise to the defacto complainant had sexual intercourse with her several times forcibly and also threatened her. Hence, the complaint.

3.The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution.

No.8131 of 2022 4.The learned Government Advocate (Criminal Side) appearing for the State would submit that the defacto complainant gave birth to a child 10 days back and DNA test is yet to be taken. 5.Considering the above facts and circumstances and also the seriousness and gravity of the offence alleged against the petitioner and also the fact that investigation is pending, this Court is not inclined to grant anticipatory bail to the petitioner. 6.In the result, this Criminal Original Petition is dismissed. sd/- 28/04/2022 / TRUE COPY / / /2022 Sub-Assistant Registrar (C.S.)
