PRAYER : Writ Petition is filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus, directing the first Respondent to impound the Passport of the 4th Respondent herein bearing Passport No. M8507166 by considering the petitioner's representation dated 06.05.2021. For R2 & R3 : Mr.R.Sivakumar Government Advocate (Crl.Side) O RDER This Writ Petition has been filed for the issue of writ of mandamus directing the first respondent to act upon the representation made by the petitioner on 06.05.2021, wherein the petitioner is seeking for impounding the passport of the fourth respondent.

2.The case of the petitioner is that the passport was given in the name of the petitioner's brother, Murugesan. The said Murugesan died long back. According to the petitioner, the fourth respondent is using the passport that was given in favour of the brother of the petitioner, viz., Murugesan and he has fabricated the passport. The petitioner gave a complaint in this regard to the first respondent and since the same was not considered, the present writ petition has been filed before this Court.

3.Considering the facts and circumstances of the case and the serious allegation that has been made by the petitioner, there shall be a direction to the first respondent to respond to the representation made by the petitioner on 06.05.2021, enquire the same and proceed further to take action strictly in accordance with law. This process shall be completed by the first respondent 2/4

within a period of eight weeks from the date of receipt of a copy of this order. The petitioner is directed to make a fresh representation along with all the relevant documents and also a copy of this order. 4.With the above direction, this Writ Petition is disposed of. No costs.
