Writ Petitions are filed under article 226 of the Constitution of India, praying to issue a Writ of Mandamus, directing the respondents 1 to 3 to conduct enquiry and submit report to the petitioner in particularly of the fraudulent sale deeds executed by the 8th respondent in favour of 6th and 7th respondents and refer to necessary legal action against the 6th to 8th respondents based on that report and to cancel the Sale Deed Nos.2326 of 2025 & 2327 of 2025 based on the representations sent by the petitioner. ORDER
This writ petition is filed to conduct an enquiry and to submit a report in particular of the fraudulent sale deeds executed by the 8th respondent in favour of the 6th and 7th respondent and refer for necessary legal action against the respondents 6 to 8, based on the report and to cancel the Sale Deed Nos.2326 of 2025 & 2327 of 2025.
2.Upon hearing the learned counsel for the petitioner and perusing the material records of the case, the case of the petitioner is that the petitioner is the owner of the property and by impersonating the petitioner, the third parties have executed the aforesaid documents. In respect thereof, the present representation is made. It is made clear that it will be open for the petitioner to approach the jurisdictional police by way of a criminal
complaint and depending on the investigation, appropriate entry will be made with reference to the document. Even otherwise, it will be open for the petitioner to present any document ,if the petitioner wants, the Sub-Registrar can conduct enquiry at that stage. It will also be open for the petitioner to approach the jurisdictional civil Court to assert title. All the remedies kept open. The Sub-Registrar cannot by himself decide whether there is impersonation or not and cancel the document. Therefore, keeping open the aforesaid liberties, this writ petition is disposed of.
