ORDER

This criminal original petition has been filed to direct the second respondent to conclude the investigation in Crime No.246 of 2023 pending on the second respondent Police Station and to file a charge sheet within a stipulated time, based on the representation given by the petitioner dated 07.03.2024.

2.The case of the petitioner is that on 11.08.2023, at about 07.45 pm., when the petitioner's husband was riding his two wheeler, a vehicle came from opposite side in a rash and negligent manner and dashed against the two wheeler of the petitioner's husband. Due to the accident, the petitioner's husband died. Based on the complaint given by the brother of the deceased, a case in Cr.No.246 of 2023 was registered. The petitioner filed the present petition to file a final report, within a time frame. 3The learned Government Advocate(Crl.side) appearing for the respondents submits that the vehicle, which is involved in the accident, could not be identified and therefore, the second respondent could not file final report.

4.The petitioner claims that on her own source, she found out the offending vehicle and she also gave a representation to the respondents on 2/4

07.03.2024. However, the respondents have not considered the same and proceeded with the investigation based on the representation. 5.In view of the rival submissions made by the learned counsel on either side, this criminal original petition is closed with a direction to the respondents to find out the truth in the representation of the petitioner dated 07.03.2024 and also find out whether the vehicle relied on by the petitioner is actually involved in the commission of offence or not. The second respondent is expected to file final report in Cr.No.246 of 2023, as expeditiously as possible.
