ORDER
(Order of the Court was made by G.R.Swaminathan J.) Heard both sides.
2.The writ petitioner joined the respondent corporation as tyre man. He was subsequently posted as programmer. The petitioner sought corresponding re-fixation of his pay, considering the post which he was holding. His request was rejected. That led to the filing of W.P(MD)No. 10474 of 2019. The said writ petition was allowed vide order dated 08.08.2019. Thereafter, W.A(MD)No.678 of 2021 was filed by the Management and the same was dismissed on 08.07.2021. Undeterred by these developments, the Management went on appeal before the Hon'ble Supreme Court of India by filing S.L.P(Civil) No.8423 of 2023. It was dismissed on 22.03.2023. Even thereafter, the order was not complied with. That led to the filing of this contempt petition. 2/5
3.There was considerable argument with regard to the quantum of pay payable to the petitioner herein. It was ultimately agreed that since the post of programmer carries the same scale of pay as that of the senior superintendent, the petitioner's scale of pay was fixed at Rs.13,10545,700/- with Grade Pay of Rs.4,900/-. The petitioner is entitled to the said scale of pay since February 2016, when he was posted as programmer. The arrears payable to the petitioner come to around Rs. 6,43,656/- (Rupees Six Lakhs Forty Three Thousand Six Hundred and Fifty Six only). An affidavit has been filed today to the effect that this amount will be settled in six(6) equal monthly installments, the first installment commencing on 01.02.2026. We make it clear that this would carry interest at the rate of 4% per annum with effect from 01.01.2022. 4.With the aforesaid directions, this Contempt Petition is disposed of.
