For Respondent : Mr.R.Srinivasan Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory bail in Crime No. 200/2021 on the file of the respondent Police ORDER : The Court made the following order :- The petitioner, who was apprehends arrest at the hands of the respondent police for the alleged offences punishable under Section 302 of I.P.C., in Crime No.200 of 2021, on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that on 30.04.2021, at about 5.00 PM, when the defacto complainant was in market doing unloading the vegitable. That time, the defacto complainant received a phone call from one Lingadurai made he informed that some body killed the Defacto complainant's brother namely Gnanasekar, and dead body found near Esakkiamman kovil with injuries. Thereafter, went to the said place and he saw the brother's body. Defacto complainant informed to the Respondent Police. 3. The learned counsel for the petitioners would submit that the petitioner is the innocent person and she has been falsely implicated in this case. He further submitted that the petitioner has undergone medical treatment. Hence, he prays for grant bail to the petitioner.

4.The learned Government Advocate (Crl.side) would submit that the deceased and the other accused used to steal and share the same themselves. There was a dispute arose between them with regard to the sharing of the theft money, due to the same, the deceased misbehaved with A2. Hence, the above said occurrence happened. He would further submitted that the petitioner has no proof for the medical treatment.

Hence, he vehemently opposed to grant anticipatory bail to the petitioner.

5. Taking into consideration the allegations and also the custodial interrogation of the petitioner is essential, this Court is not inclined to grant anticipatory bail to the petitioner.
