ORDER

This Criminal Original Petition has been filed to direct the learned Judicial Magistrate - II, Combined Courts for Dindigul, 1/4

Dindigul District to assign a case number in S.T.C(SR) No.12509 of 2024 and to conduct a trial expeditiously and dispose of the case. .

2. The learned counsel for the petitioner submitted that the petitioner, who is the complainant before the trial Court, seeks to number the petition and to expedite the trial in the learned Judicial Magistrate - II, Combined Courts for Dindigul, Dindigul District, due to undue delays. The case has been filed under Section 138 r/w. 142 of NI Act and the petitioner has filed the petitions before the trial Court several times and the same were returned i.e.07.02.2024, 06.03.2024, 28.06.2024 stating that the petitions do not comply necessary requirement. Due to which, the petitioner is suffering mental agony and hardship. Hence, the present Criminal Original Petition came to be filed.

3. Heard the learned counsel for the petitioner and carefully perused the materials available on record.

4. Considering the nature of the case, the petitioner is directed to re-submit the petition in S.T.C.(SR) No.12509 of 2024 after rectifying the defects, if any. On receipt of the same, the learned Judicial Magistrate - II, Combined Courts for Dindigul, Dindigul District, is directed to number the case in S.T.C(SR) No.12509 of 2024 and dispose the same as expeditiously as possible within a period of six (6) months from the date of receipt of a copy of this order.

5. With the above directions, this Criminal Original Petition is disposed of.
