Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the first respondent herein to take the petitioner's appeal dated 01.12.2021 on file and proceed in the manner known to law by considering the petitioner's representation dated 12.04.2022. For Petitioner : Mr.P.Samuel Gunasingh For Respondents : Mr.D.Sasikumar, Additional Government Pleader.

ORDER

This Writ Petition has been filed seeking for a limited relief.

2. The petitioner seeks for early disposal of the statutory appeal dated 01.12.2021 filed by him aggrieved by the order dated 26.11.2021 passed by the second respondent. Under the order dated 26.11.2021, the second respondent has refused to register the settlement deed presented by the petitioner for registration on the ground that the subject property belongs to a temple.

3. No prejudice would be caused to the respondents, if the petitioner's statutory appeal is disposed of by the first respondent within a time frame to be fixed by this Court after hearing the petitioner and other necessary parties, whom the first respondent deems fit to enquire and also after considering the documents produced by the respective parties.

W.P.(MD).No.8572 of 2022 respondent to pass final orders on the petitioner's statutory appeal dated 01.12.2021 within a period of four (4) months from the date of receipt of a copy of this order after affording a fair hearing to the petitioner as well as the temple, who claims ownership of the very same property and also any other necessary party, whom the first respondent deems fit to enquire, including granting them the right of personal hearing.

5. With the aforesaid direction, this Writ Petition is disposed of. There shall be no order as to costs.
