O R D E R

This criminal original petition has been filed seeking a direction to direct the respondent police to accord police protection to the petitioner to tape rubber plantation in the land comprised in R.S.No.495/4, Attur Village, Thiruvattar Taluk, Kanyakumari District, admeasuring 97cents.

2.Today, when the petition is came up for hearing, the learned Additional Public Prosecutor appearing for the respondents 1 and 2, on instructions, would submit that for the same dispute, the petitioner herein on 17.06.2020, preferred a complaint before the second respondent and on receipt of the same, the the second respondent herein initiated an enquiry in C.S.R.No.423 of 2020. During the time of enquiry, on 08.07.2020, the petitioner himself submitted a letter to the second respondent as he has to approach the competent Court for resolving the dispute having by him with the third respondent. After receiving the said letter given by the petitioner, the enquiry has been closed.

Crl.O.P.(MD)No.8256 of 2020 3.Now on considering the submission made by the learned Additional Public Prosecutor, it would reveal the fact that the present petition has been filed by the petitioner for the same relief as prayed in the petition dated 17.06.2020. So the attitude committed by the petitioner is nothing, but waste of time. Accordingly, the petition filed by the petitioner is devoid of merits.

4.In view of the above, this Criminal Original Petition is dismissed.
