PRAYER: Criminal Original petition has been filed under Section 528 of BNSS to direct the 1st respondent to transfer the investigation of the case in Crime No. 10 of 2025, pending before the 3rd respondent police, to some other competent agency, based on the petitioner's representation dated 26.02.2025.

O R D E R

This Criminal Original Petition has been filed to direct the 1st respondent to transfer the investigation of the case in Crime No. 10 of 2025, pending before the 3rd respondent police, to some other competent agency, based on the petitioner's representation, dated 26.02.2025. 2.According to the petitioner, she is the mother of the deceased. Her second son died in a suspicious manner, thereby, a case in Cr.No.10 of 2025 has been registered by the respondent police, based on the complaint lodged by her husband. Thereafter, the 3rd respondent has not conducted any proper investigation. In this regard, the petitioner sent a representation on 26.02.2025, but the same has not been considered. Hence this petition seeking transfer of investigation. 2/5

3.The learned Government Advocate (Crl.Side) appearing for the respondent police would submit that due to love failure, the petitioner's son has committed suicide. In this regard, a case has been registered based on the complaint given by the deceased's father/petitioner's husband. After conducting proper investigation, it came to known that the deceased has consumed poison and his medical records were also revealed the same. Therefore, they have closed the case as 'action dropped'. Therefore, transfer of investigation does not arise and this petition is liable to be dismissed. 4.Considering the prayer sought for in this petition and already in this case, investigation has been completed and closed as 'action dropped', nothing survives for further adjudication. 5.Accordingly, this petition stands closed. However, the petitioner is at liberty to challenge the final report in the manner known to law, if she is aggrieved.
