PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the 1st Respondent to instruct the 2nd Respondent to dispose the Appeal dated 30.05.2022 pending before the 2nd Respondent to cancel the fraudulent patta in the name of 4th to 7th Respondents and issue patta in favour of the Petitioner and the property in Survey No.256/4C, now U.D.R. Survey No.108/4C1 of an extent of 26 cents 115 square feet which is situated at West side of Theerthakadu, Vandiyur Bit II Village, Teppakulam Sub Registration Office, Madurai East Taluk, Madurai District may be fixed stipulated time.

This petition has been filed seeking to direct the 1st Respondent to instruct the 2nd Respondent to dispose the Appeal dated 30.05.2022 pending before the 2nd Respondent to cancel the fraudulent patta in the name of 4th to 7th Respondents and issue patta in favour of the Petitioner and the property in Survey No.256/4C, now U.D.R. Survey No.108/4C1 of an extent of 26 cents 115 square feet which is situated at West side of Theerthakadu, Vandiyur Bit II 2/5

Village, Teppakulam Sub Registration Office, Madurai East Taluk, Madurai District may be fixed stipulated time.

2. The learned Additional Government Pleader appearing for respondents 1 to 3 submitted that notice had already been issued to the parties in the appeal on 12.07.2023, but the enquiry has not yet been completed.

3. Considering the above facts, this Court directs the 2nd respondent to issue fresh notice to the petitioner and respondents 4 to 7, conduct an enquiry, and thereafter pass appropriate orders within a period of four months from the date of receipt of a copy of this order.
