O R D E R

This criminal original petition has been filed seeking the relief to call for the records pertains to the proceedings in Na.Ka.No.A4/3917/2020, dated 11.07.2020 pending on the file of the 1/3

first respondent and quash the same as illegal.

2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondents 1 and 2.

3. Now on going through the summons issued by the first respondent, it appears that all the petitioners herein were directed to appear before him for the hearing dated 30.07.2020.

4. In this regard, the learned Additional Public Prosecutor appearing for the respondents 1 and 2, on instructions, would submit that for the above said hearing, all the petitioners herein (except the fourth petitioner) had appeared before the first respondent and therefore, the prayer sought for by the petitioners has become infructuous.

5. He would further submit that in respect to the fourth petitioner, in the report submitted by the first respondent, he has stated as since the said person (fourth petitioner) viz.,.Ponnysamy, is residing in Tiruppur, he could not appear before him for the said hearing date and therefore, the proceedings initiated against him was withdrawn.

6.Therefore, in view of the above, no further order is necessary in this Criminal Original Petition and accordingly, the Criminal Original Petition stands dismissed as infructuous. Consequently, the connected miscellaneous petition is closed.
