ORDER

(Order of the Court was made by N.SATHISH KUMAR, J.) Alleging disobedience of the order made in W.P(MD)No. 9614 of 2020 dated 24.06.2025, this contempt petition is filed. 2.

The petitioner filed the abovesaid writ petition for a Mandamus, directing the respondents 1 to 5 to remove the encroachments and blockages made by the respondents 6 to 8 in the drainage constructed by the 5th respondent for the benefit of the residents of the South Street, Subramaniapuram, Sivakasi Taluk, Virudhunagar District and maintain the drainage in hygienic and proper condition free 2/6

from encroachment or obstruction by any person. 3.

This Court by order dated 24.06.2025 has passed the following order:

''3. At the outset, the complaint made by the petitioner in this regard shows that drainage facility is not properly provided to the residents residing in that locality. Improper drainage facility is causing health hazards to the children, aged people residing in that locality and therefore, the authorities concerned are bound to provide proper drainage facility and to ensure free flow of sewage.

4. Undoubtedly, the complaint of the petitioner is serious in nature. Drainage routes are to be cleared properly and the authorities concerned must ensure that sewage water reaches the appropriate place, without causing any environmental damages to the people of that locality. In view of the serious complaint made by the petitioner, the respondents 1 to 5 are directed conduct an inspection and rectify the irregular flow of sewage water and to ensure free drainage flow, without any stagnation. Such an exercise is directed to be completed within a period of twelve weeks from the date of receipt of a copy of this order.

5. It is made clear that in the event of non-compliance of the above directions issued by this Court on the part of the 3/6

respondents concerned, the petitioner is at liberty to move this Court for the noncompliance of the directions issued by this Court and in such an event, this Court will view the inaction of the respondents concerned seriously.

6. Accordingly, this writ petition is disposed of. No costs.''

The respondents have filed a report stating that drainage system is properly laid and in fact, the writ petitioner has opposed to the drainage line in front of his house. The photographs filed along with the report clearly indicate that drainage system has been properly constructed by the respondents.

The drainage canal is being constructed in front of the petitioner's house, which is the main grievance of the petitioner and hence, he has filed this contempt petition with individual interest.
