: Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, issue a of a Writ of Mandamus, directing the 2nd and 3rd respondents to conduct fair enquiry on the representation given by the petitioner dated 14.10.2023 and consequently to issue patta to the petitioner in the property in S.No.872/1A at Sangarankudieruppu of Pudhukulam Village in Sathankulam Taluk to an extent of 35 cents.

The petitioner seeks issuance of Writ of Mandamus to direct the respondents 2 & 3 to conduct enquiry based on the petitioner's application dated 14.10.2023, for cancellation of patta issued erroneously.

2.It is the case of the petitioner that the second respondent, after receipt of the application from the petitioner, has forwarded the same to the third respondent by proceedings dated 30.10.2023. However, as rightly contended by the learned Government Advocate, it is the Revenue Divisional Officer, who has forwarded the application to the Tahsildar, calling for a report. He would further submit that enquiry is pending before the Revenue Divisional Officer, Tiruchendur.

3.In view of the above, it would be sufficient to dispose of the Writ Petition, directing the Tahsildar, third respondent herein to conclude the enquiry and forward the report to the Revenue Divisional Officer, Tiruchendur, within a period of four [4] weeks from the date of receipt of a copy of this order. On receipt of the 2/5

report from the Tahsildar, the Revenue Divisional Officer, Thiruchendur, shall conduct necessary enquiry affording an opportunity to the parties and pass final orders, within a period of twelve [12] weeks thereafter.
