PRAYER : Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the 3rd respondent to pass orders on the petitioner's application dated 28.01.2020 and to issue a patta in the petitioner's name for 540 sq.ft., house site in Survey No.74/4 in Melamadai Village-I Bit, Madurai East Taluk, Madurai within a time limit to be fixed by this Court. ORDER

This Writ Petition is filed to direct the third respondent to pass orders on the petitioner's application dated 28.01.2020 and to issue patta in the petitioner's name for 540 sq.ft., house site in Survey No.74/4 situated at Melamadai Village-I Bit, Madurai East Taluk, Madurai.

2.Heard Mr.A.Thirumurthy learned counsel appearing for the petitioner and Mr.M.Pandiarajan, learned Additional Government Pleader appearing for the respondents.

3.The learned counsel appearing for the petitioner submitted that since the Tahsildar has passed an order in his proceedings No.Na.Ka.No.2039/2020/E2, dated 13.08.2020, liberty may be granted to the petitioner to challenge the said order before the appropriate https://hcservices.ecourts.gov.in/hcservices/ 1/2

4.In view of the submission made by the learned counsel appearing for the petitioner, this Writ Petition is dismissed with liberty to the petitioner to challenge the order of the Tahsildar before the appropriate forum in the manner known to law. Further, the Tahsildar, Madurai, shall communicate the copy of the order dated 13.08.2020 to the petitioner, within a period of two weeks from the date of receipt of a copy of this order. No costs.
